Reynolds American Inc. (RAI:US) and Lorillard Inc. (LO:US) urged U.S. health officials to move more quickly on regulating e-cigarettes, saying the lack of clear rules makes it harder for smokers to switch to the less-hazardous products.

The U.S. Food and Drug Administration needs to establish guidelines for the industry and create a level playing field for e-cig competitors, Reynolds Chief Executive Officer Susan Cameron said yesterday at the Global Tobacco Networking Forum. Lorillard CEO Murray Kessler, speaking at the same conference, echoed those remarks. If the agency fails to act in time, it could jeopardize the huge potential health benefits from converting smokers to the newer technology, he said.

The two companies, which agreed this year to merge in a $25 billion deal, are fighting to protect the nascent e-cig industry. The new products are touted as a healthier alternative to traditional cigarettes because they emit vapor rather than tar, ash and smoke. Still, they’ve come under increasing scrutiny from both local and federal officials, who say the health effects of the vapor aren’t fully known.

PHOENIX — Arizona lawmakers are considering taxes on electronic cigarettes as a way to help cover a $1 billion budget shortfall, the Arizona Capitol Times reported.

“It’s one option of many that we should look at at the Legislature,” said state Democratic Rep. Stefanie Mach of Tucson, who serves on the House Appropriations Committee. “It certainly isn’t going to come close to the amount of money that we need to make up the deficit, but any little bit helps.”

Some legislators are lighting up at the idea of taxing e-cigarettes to cover a huge deficit expected by fiscal year 2017, but how to regulate the devices has been a source of debate.

Legislators in dozens of states last year were faced with bills related to electronic cigarettes. Two states have already enacted “sin taxes” on them, according to the National Conference of State Legislatures. On the federal level, the Food and Drug Administration has struggled since 2011 to implement rules on how to categorize and regulate them as well as liquid nicotine.

Republican Rep. John Kavanagh, of Fountain Hills, said taxing e-cigarettes could discourage people from using them in an effort to quit smoking.

“The e-cigarettes, I am told, are not nearly as damaging to the body as tobacco is, and part of the reasoning for the tobacco tax is to compensate society for the additional costs in medical care that smokers cause,” said Kavanagh, who also serves on the House Appropriations Committee and running for a Senate seat.

The financial impact for Arizona from e-cigarette taxes is difficult to determine since proposals vary and cigarettes have about $2 in additional taxes per pack.

Arizona so far hasn’t enforced many restrictions on the electronic devices. Last year, the state made it illegal to sell them to minors. But Attorney General Tom Horne recently said e-cigarettes do not fall under the Smoke Free Arizona Act. Thus, patrons can smoke them inside restaurants, bars and other public places. However, cities such as Tempe have banned them.

World Health Organization calls for ban on indoor vaping and fruity e-cigarettes

The World Health Organization (WHO) today published a report calling for a ban on the use of electronic cigarettes indoors, as well as restrictions on e-cigarette advertising and sales to minors. The report also calls for regulations on the contents of e-cigarettes and raised concerns over the interests of major tobacco companies, which have begun to command a greater share of a market that saw $3 billion in sales last year.

Today’s report comes two days after the American Heart Association (AHA) weighed in on the debate, saying in a statement that e-cigarettes could be used to help people quit smoking. Health experts are divided on the benefits and potential pitfalls of using e-cigarettes, with some saying they could save lives by turning people away from traditional cigarettes, and others warning that they could “renormalize” smoking and encourage youths to pick up the habit. But both the AHA and WHO agree that stronger regulations are needed, with each organization raising concerns over how the products are marketed. The AHA also said that they should be regulated under existing rules for tobacco products.

In its report, the WHO called for a ban on fruity- and candy-flavored e-cigarette products that may appeal to minors, and that their “e-liquids” should be regulated to “minimize content and emissions of toxicants.” It also suggested that governments regulate the health claims that some manufacturers are making in the absence of strong empirical evidence, and recommended bans on vending machines in most places. The organization added that e-cigarettes expose non-smokers and bystanders to nicotine, and that evidence suggests that their emissions are “not merely water vapor” as many believe.

The report was published as part of the WHO’s Framework Convention on Tobacco Control, an international public health treaty that came into effect in 2005. Since then, 179 countries have ratified the treaty, with the US standing as a major exception.
